This document / agreement / terms of use (“Agreement” / “Terms”) sets forth the general terms and conditions that apply to the access and use of website at https://dietplus.co.in (“Website”) OR (“App”) operated and managed by RJSTechLabs (6th floor, Hiranandani Business Park, Saki Vihar Rd, Tunga Village, Chandivali, Powai, Mumbai, Maharashtra 400072) and may include its affiliates ( “Company” / “sole proprietor”/ “we” / “us” / “our”). The Terms constitute a legally binding agreement between users accessing the App / Website (“you” / “your” / “user”) and Company / Sole proprietor regarding your use of the App, Website and other associated services.
By enrolling in a membership with Dietplus Healthcare (“Company,” “sole proprietor,” “we,” “us”), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use our services. If any user does not agree to terms of use and our privacy policy published on website (https://www.app.dietplus.co.in/privacy-policy ), or you are under 18 years of age, please do not use our services. Below terms and conditions governs your usage of our website (online services) and offline (in-clinic services); you accept that you have agreed to this disclaimer in full. 2. Medical Disclaimer
• Informational Purpose Only: All online content or advisory services provided by Dietplus Healthcare, including nutrition plans, fitness advice, and health coaching, is for informational and educational purposes only.
• No Medical Advice: We are not medical professionals. Our services are not a substitute for professional medical advice, diagnosis, or treatment.
• Consult Your Physician: You should consult with a healthcare provider before starting any new diet or exercise program, especially if you have pre-existing conditions, are pregnant, or are taking medication.
• Emergency Situations: If you experience a medical emergency, stop using our services immediately and contact emergency services.
• Partners: We do not recommend or endorse any specific tests, physicians, procedures, opinions, or other information that may appear in our membership or website. If you rely on any of the information provided, you do so solely at your own risk.
• Quality: Dietplus healthcare makes every effort to validate the qualifications of the medical consultants & professional, as we aspire to become a single source of quality diet and nutrition information to source non-emergency medical care. Nevertheless, we make no guarantees, representations or warranties whatsoever, whether expressed or implied, with respect to professional qualifications, expertise, quality of work or other information herein. Further we do not in any way endorse any individual, company or partner. In no event shall we be liable to you or anyone else for any decision made or action taken by you in reliance on such information.
3. Membership & Billing
• Subscription Basis: Memberships are billed on a [Monthly/Quarterly/Annual] basis.
• Automatic Renewal: Your membership will automatically renew at the end of each billing cycle unless cancelled.
• Payment: You agree to provide a valid payment method. We reserve the right to suspend access if payment fails.
• Contract: By using Dietplus Healthcare Services, no contractual or professional relationship is created between user and Dietplus Healthcare and its company, proprietors, partners, affiliates, employees or any other related parties
• Membership charges: Dietplus Healthcare reserve the right to alter subscriptions and service packages at any time. If we alter the price of a package that you are already paying for, we will provide notice of the change to you over registered mobile phone or email and you will have the option to cancel your membership if you do not agree with the new price being offered to you.
• Follow-up services: Diet follow-up sessions offered within membership plans are offered via (email / phone) for 30mins each as per selected membership plans. Follow-up sessions must be booked online in advance via the user from their online account and by putting a follow-up session online request or by calling our support service number. Follow-ups beyond free membership entitled sessions will be charged as per fixed rates
• Reporting timelines: Dietplus Healthcare membership provides multiple reports like diet health and food habits assessment, body fat analysis and personalized diet plan based on information provided by online or in-clinic visiting patients or members. Report delivery can take at-least 5 working days to deliver on email or physical delivery. Delivery timelines may get delayed (due to unforeseen reasons) without any prior notice to users. Users agree and understand that Dietplus Healthcare will try its best to provide timely services, but delays can happen without prior notice due to volume pressures, technology glitches and other unknown circumstances.
• Payment partner: For any online payment services we work with Razorpay. We do not store any payments data (credit, debit, UPI, bank account), all security and risks related to payments are handled by Razorpay. • Service Partners: By enrolling in Dietplus Healthcare services ("Membership"), you agree to these terms regarding the access and use of services, discounts, and products provided by our affiliated third-party vendors ("Partners"). These terms supplement the general Membership Agreement.
o Independent Entities: Partners are independent businesses and are not employees, agents, or joint ventures of Dietplus Healthcare.
o Availability: Partner offerings are subject to change, substitution, or discontinuation at any time without prior notice.
o Access: Access to Partner services may be contingent upon your Membership remaining in "Good Standing" (e.g., all dues paid).
o Separate Contractual Relationship: When you utilize a Partner service, you may be required to agree to that Partner’s specific terms of use, privacy policies, or service agreements. Your legal relationship for the delivery of the specific service is directly with the Partner, not with the Dietplus Healthcare Membership Program.
o Limitation of Liability: Dietplus Healthcare strives to vet all Partners for quality however:
No Warranty: We make no guarantees regarding the quality, safety, or legality of Partner offerings.
Indemnification: You agree to hold Dietplus Healthcare harmless from any claims, damages (monetary, health, any other), or disputes arising from your interaction with a Partner.
Dispute Resolution: Any disputes regarding service delivery, product defects, or scheduling must be resolved directly with the Partner.
Data: To facilitate your access to Partner perks, Dietplus Healthcare may share data (such as your name or membership ID) with the Partner to verify your eligibility. All data sharing is conducted in accordance with our [(https://www.app.dietplus.co.in/privacy-policy]. Once you engage with a Partner, any data you provide to them is governed by their privacy policy.
Code of Conduct: Members are expected to treat Partners with professionalism. Abuse of Partner services or staff may result in the immediate termination of your Membership without refund.
• Data: By using our website and our offline in-clinic services you are providing consent to us for collecting data (both personal and medical). While we don’t have any intention to share personal or medical data of any user to a third party, for providing better experience and personalized promotional content we may share user data with third party partners without any prior notice to you. We should not be responsible for any of our third-party partners data privacy processes, norms and security protocols. We will not be liable for any online or physical loss of user’s data and should NOT be liable in whatsoever for any monetary or personal identity losses by the user in any such events.
• Online use: Online registration as a user with the service requires both a user name and a password, and certain portions of the service may require use of multiple one-time or persistent passwords. User should consider his/her user names and passwords, OTPs as confidential information. Anyone with knowledge of the user’s user name and password can gain access to the restricted portions of this Service and to the user’s account. The user must keep his/her user name and password confidential.
• Delivery: All timelines related to delivery of reports or advisory services are dependent on pressure volumes on certain days, users will be well informed and communicated via email on any such delays
4. Cancellation and Refund Policy
• Cancellation: You may cancel your membership by emailing support@dietplus.in
• Refunds: All sales are final. No refunds for partial months
• Termination: We reserve the right to terminate your membership for conduct that violates these terms or is deemed harmful to our community.
5. Results and Expectations
• No Guarantees: Health and weight loss results vary based on individual effort, genetics, and adherence. Dietplus Healthcare does not guarantee specific weight loss or health outcomes.
• Individual Responsibility: You acknowledge that your progress is dependent on your own actions and lifestyle choices.
• Health risks: Members are solely responsible for your health status and wellbeing, we are only providing diet based informative services, any medical health risk are to be owned fully by the user, we (Dietplus Healthcare) should NOT be liable in whatsoever for any health or monetary loss in any such events
6. Intellectual Property
All materials provided (meal plans, recipes, workout videos, diet plans or assessment reports in PDFs) are the intellectual property of Dietplus Healthcare. Membership grants you a personal, non-transferable license. You may not resell, redistribute, or use our content for commercial purposes.
7. Data Privacy
Your privacy is paramount. We collect and process your personal and health data in accordance with our Privacy Policy published on website (https://www.app.dietplus.co.in/privacy-policy ). By using our services, you consent to the collection of data necessary to personalize your nutrition plan and membership communications.
8. Limitation of Liability
• To the maximum extent permitted by law, Dietplus Healthcare shall not be liable for any direct, indirect, or consequential damages (monetary, health related, or any other) resulting from your use of our services, including but not limited to physical injury, illness, or allergic reactions.
• We do not warrant that your use of the Services will be secure, uninterrupted, always available, error-free or will meet your requirements, or that any defects in the Services will be corrected. We disclaim liability for, and no warranty, representation, condition or other term is made with respect to, the connectivity and availability of the Services.
• Our total liability to you in connection with these terms of use or the use of the Services shall be limited to the fees paid by you to us for use of the services / subscription if you are a paid member.
9. Indemnity
• You agree to indemnify us, our proprietors, consultants, directors, employees, agents, Group Companies and third parties for any claims, causes of action, debts, losses, costs, liabilities and expenses (including reasonable legal fees) relating to or arising, directly or indirectly, out of: (i) your, on anyone using your account’s use of or inability to use the Services, (ii) any content or information posted by you or anyone using your account, (iii) your or anyone using your account’s violation of these terms of use or your or anyone using your account’s violation of any rights of a third party, or (iv) your or anyone using your account’s violation of any applicable laws, rules or regulations. We reserve the right, at our own cost, to assume the exclusive defence and control of any matter otherwise subject to indemnification by you. You agree to provide us with full co-operation if we choose to exercise this right.
10. General Terms of Use
• Dietplus Healthcare working days are Monday to Friday 10am to 4pm (IST). All our services are available only during these days and times as per prior bookings workloads and staff availability. Our customer service also operates during these days and time. Users are advised to book appointments keeping view of the specified timings for all follow-up sessions and customer support services. Dietplus Healthcare follows Indian Bank Holiday calendar and remains shut on all published public holidays in the calendar year
• Dietplus Healthcare has several alliances with partner brands. All such users who access Dietplus Healthcare services through such strategic partnerships are bound to accept our terms of use and our privacy policy and agree to abide by them.
• For the purposes of these Terms, Force Majeure Event means an event beyond the reasonable control of Dietplus Healthcare including but not limited to strikes, lock-outs or other industrial disputes (whether involving the workforce of the Dietplus Healthcare or any other party), failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors. Dietplus Healthcare shall not be liable to the user as a result of any delay or failure to perform its obligations under these Terms as a result of a Force Majeure Event. If the Force Majeure Event prevents Dietplus Healthcare from providing any of the services for more than 4 weeks, Dietplus Healthcare shall, without limiting its other rights or remedies, have the right to terminate these Terms immediately without giving written notice to the user
11. Jurisdiction and Applicable Law
• These terms of use and the documents referred to in them shall be governed and construed in accordance with Indian law. Any disputes relating to these terms of use, the documents referred to in them or the site or the Services will be subject to the exclusive jurisdiction of the Mumbai, India courts.
12. Risk of Using Our Services
You are solely responsible for all risk when using the site and our in-clinic services:
• To maintain and run services as per reasonable delivery timelines we do outsource work to appointed third-party consultants, dieticians, healthcare professionals. Users data can be shared with our appointed consultants without any prior notice, while processes will be in place to protect user data there is risk on internet of data breaches and online data theft, we should NOT be liable for any such events whatsoever which may lead to any health, monetary, personal identity or data losses.
• By using the site and our services you are providing consent to us for collecting data (both personal and medical). We are not liable for any data breaches due to any online thefts, phishing, malware or virus attacks. While we do protect our systems and database, we are not an IT services provider. We work with third party hosting partners and follow best protocols, but we will not be liable for any online loss of user’s data and should NOT be liable in whatsoever for any monetary or personal identity losses by the user.
• By using the site and our services you are providing consent to us for collecting data (both personal and medical). While we don’t have any intention to share personal or medical data of any user to a third party, for providing better experience and personalized promotional content we may share user data with third party partners without any prior notice. We should not be responsible for any of our third-party partners data privacy processes, norms and security protocols. We will not be liable for any online loss of user’s data and should NOT be liable in whatsoever for any monetary or personal identity losses by the user in any such events.
